LUNARPAGES.COM'S CAVEAT EMPTOR

- A story of Technical Incompetence -

LUNARPAGES.COM is a company based in the east coast of the USA and provides webhosting service with variety of features which on the surface appear very enticing.

 

My experience with them requires that all should be alert to its level of technical incompetence and the danger it could pose

to services provided by your website when hosted on the site.

 

My story started on August 6, 2005 when I received an e-mail from LUNARPAGES.COM, it is partly reproduced below:


We have received complaints of spam originating from your domain dawodu.com.  
If we continue to receive complaints, we will have no choice but to suspend your account.  
We have a zero tolerance toward spam as it states in our Terms of Service 
and this issue must be addressed immediately.

**WHAT IS SPAM?**
-------------------------

Spam is unsolicited bulk email.  This can originate from any type of mass 
mailing such as a mailing list or mass email from a forum.  Most spam is used to sell or promote a 
product but it can also be newsletters or announcements.  Many ISP’s make it very easy to report spam; 
therefore, everyone must take steps to avoid accusations.  Lunarpages must comply with the regulations 
for 
preventing spam or our servers will be in jeopardy of becoming blacklisted.  Blacklisting a server will 
affect every customer on the server not just a specific account.

First of all, I was shocked because I do know as a matter of fact that the DAWODU.COM domain name has never been

used by any of us for spam. It is also common knowledge that people good send out "spoof" e-mails using a domain name

and one will expect LUNARPAGES.COM if they are really technically savvy, to do an IP address tracing to confirm if the spams were actually originating from the server(lunarpages) on which DAWODU.COM was being hosted.

 

So, on August 9, 2005, I wrote an e-mail of denial to LUNARPAGES.COM explaining in simple terms the above and the fact

that it could do an IP address tracing as explained above. LUNARPAGES.COM being technically incompetent and not understanding what was explained above sent a reply to explain the spam, it is partly reproduced below :

 

Hello,

Unfortunately, AOL makes it very easy to report email as spam.  Because of
this, we suggest not allowing AOL signups to mailing lists or forums. 
Instead, have AOL users supply an alternate email address such as a free
account like hotmail.  

Below I am pasting the email that was reported by an AOL user.  Due to privacy
issues, AOL will not disclose the party reporting the email so we have no way
of knowing the specific email that complained.

He had only $9.5mllion in his a/c and the a/c is coded. It is only an
insider that could produce the code or password of the deposit
particulars.Asitstands now, there is nobody in that position to produce
the needed information other than my very self considering my position
in the bank as his account officer.
Based on the reason that nobody has come forward to claim the deposit as
next ofkin, I hereby ask for your co operation in using your name as the
next ofkin to the deceased to send these funds out to a foreign
offshorebank a/c for mutual sharing between myself and you.You should

Again, I was shocked to receive this response from LUNARPAGES.COM and this time around, their technical

incompetence was becoming glaring. First, what they referred to as a spam was actually not originating from the DAWODU.COM domain and their angst which they erroneously referred to as spam originating from me was  the fact that a spam letter contained LINKS to an article from DAWODU.COM (see above).

 

I wrote back to LUNARPAGES.COM, pointing out the fact that the article being linked to is an article of an incidence that actually occurred and that I have no control over the entire INTERNET and personal e-mails of anyone who wishes to

put a link to an article on DAWODU.COM. I also pointed out to LUNARPAGES.COM the fact that the e-mail had within

it a link to an article on the same incidence on the BBC website. A reply to this was reinforcing the ignorance and technical incomptence of those at LUNARPAGES.COM.

 

On September 23, 2005, I got a repetition of the same e-mail warning of spam which again was denied by me and referring them to previous e-mail exchanges on the issue.

 

Finally on October 13, 2005 at midnight PST, webhosting of DAWODU.COM was suspended by LUNARPAGES.COM

without notice to enable me move the site elsewhere. This led to DAWODU.COM being off the web for 48-72 hours while I scrambled to move all the pages to a different host and unable to retrieve data (still on LUNARPAGES.COM server) including e-mails and robust discussions on the public discussion forum.

 

This action of LUNARPAGES.COM has brought it out as a company of incompetent below par performers who could not understand the basic things and not following sensible procedure that will enable a site like ours to be able to legitimately

move our data from its server. We are currently looking at our legal options against LUNARPAGES.COM.

 

We do hope that others we learn from this experience while dealing or planning to deal with LUNARPAGES.COM

 

As every Contract law student will tell you, CAVEAT EMPTOR (Latin for "Let Buyers Beware").
